Ellen London

Ellen has extensive experience as a litigator, in both private practice and at the Department of Justice. Before founding London & Stout, the predecessor of London & Naor, Ellen was a partner at a litigation boutique in San Francisco; before that, she served for almost a decade as an Assistant United States Attorney (“AUSA”) in the Civil Divisions of the Southern District of New York and the Northern District of California.

As an AUSA, Ellen handled a variety of complex and high-stakes matters, including those involving the False Claims Act; the Financial Institutions Reform, Recovery, and Enforcement Act; the Anti-Kickback Statute; the Freedom of Information Act; the Administrative Procedure Act; constitutional law; tax and bankruptcy; torts; and appeals. Ellen successfully prosecuted multiple billion-dollar cases, including serving as trial counsel in a FIRREA action resulting in a $1.2 billion judgment and as one of the lead counsel in the Wells Fargo sales practices investigation resulting in a $3 billion settlement. Ellen has led False Claims Act cases resulting in large recoveries for the government, successfully prosecuted health care fraud and anti-kickback matters, and obtained large recoveries for the government in tax cases. She has also argued and won multiple appeals in the Second and Ninth Circuits. In 2015, Ellen was a recipient of a Director’s Award for Superior Performance as an Assistant United States Attorney as well as the Award for Excellence from the Council of the Inspector General on Integrity and Efficiency.

Before serving as an AUSA, Ellen worked at two law firms in New York City. In private practice, she has represented and advised numerous companies and individuals in a range of matters, including navigating government requests for information, internal and/or government investigations, and various commercial disputes (on both the plaintiff’s and defendant’s sides). She also has represented both entities and individuals in pro bono matters.

Ellen is actively involved in the Bay Area Jewish community. She was selected to be a Federation Fellow as part of the Jewish Community Federation; she is a member of the Board of Directors at Sinai Memorial Chapel; and she is the First Vice President of the Board of Directors at Congregation Netivot Shalom. Ellen previously served as a member of the Board of Directors of Luna Dance Institute.

Representative Matters

  • Conducted multiple high-profile and sensitive internal investigations for a large quasi-public entity;
  • Represented executives in FTC depositions;
  • Represented technology company in arbitration arising from a claimed breach of contract;
  • Represented technology company in responding to various claims for indemnification from customers;
  • Represented companies in a challenge to denial of PPP loan forgiveness in which the government agency changed its position and granted full forgiveness to our clients;
  • Obtained favorable settlement, with a limitation on the conduct covered and no admissions of fact or liability, for an executive and company in a federal False Claims Act case in the Northern District of California; and
  • Represented company facing multiple civil and criminal inquiries arising from various wildfires.
